Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using https://forseee.com/ (“the Service”) operated by FORSEEE (“us”, “we”, or “our”).
Your access to use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Forseee offers a range of subscriptions plans to its Services (each, a “Plan”). Each Plan includes includes a numerical range of user interactions or engagement views that may be recorded by our Services on your registered web page in any given month of the subscription period.
You will select your Plan as part of your registration for the Services, which may begin with Free Trial. Each subscription period for a Plan will be based on the subscription period chosen (e.g. monthly, annually, quarterly). You are responsible for subscription fess for the entire subscription period chosen.
At the end of your current subscription period, your Plan will not automatically renew. If you intended to use this Services again, you can select any subscriptions plans based on the subscription period chosen.
A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide FORSEEE with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize FORSEEE to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, FORSEEE will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
We may offer one or more Services available to you on a trial basis free of charge until the earlier of
(a) the end of the free trial period for which you registered or are registering to use the applicable Service or
(b) the start date of any Services purchased by You.
Additional trial terms and conditions may appear on the trial registration web page. Any such additional terms and conditions are incorporated into this Agreement by reference and are legally binding.
You may be required to enter your billing information in order to sign up for the Free Trial. If you do enter your billing information when signing up for the Free Trial, you will not be charged by FORSEEE until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
At any time and without notice, FORSEEE reserves the right to
(i) modify the terms and conditions of the Free Trial offer, or
(ii) cancel such Free Trial offer.
FORSEEE, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
FORSEEE will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
You agree not to:
a) upload, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, alarming, distressing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
b) use the Services to harm minors in any way;
c) use the Services to impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;
d) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Services;
e) remove any proprietary notices from the Site;
f) cause, permit or authorize the modification, creation of derivative works, or translation of the Services without the express permission of FORSEEE;
g) use the Services for fraudulent purposes;
h) take any action that may undermine the feedback or ratings systems;
i) attempt to decompile, reverse engineer, disassemble or hack the Services (or any portion thereof), or to defeat or overcome any encryption technology or security measures implemented by FORSEEE with respect to the Services and/or data transmitted, processed or stored by FORSEEE;
j) harvest or collect any information about or regarding other Account holders, including, without limitation, any personal data or information;
k) upload, email, post, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
l) upload, email, post, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
m) upload, email, post, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other unauthorised form of solicitation;
n) upload, email, post, transmit or otherwise make available any material that contains software viruses, worms, Trojan-horses or any other computer code, routines, files or programs designed to directly or indirectly interfere with, manipulate, interrupt, destroy or limit the functionality or integrity of any computer software or hardware or data or telecommunications equipment;
o) disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other Users of the Services are able to type, or otherwise act in a manner that negatively affects other Users’ ability to engage in real time exchanges;
p) interfere with, manipulate or disrupt the Services or servers or networks connected to the Services or any other User’s use and enjoyment of the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Site;
q) take any action or engage in any conduct that could directly or indirectly damage, disable, overburden, or impair the Services or the servers or networks connected to the Services;
r) use the Services to intentionally or unintentionally violate any applicable local, state, national or international law, rule, code, directive, guideline, policy or regulation including, without limitation, laws and requirements (whether or not having the force of law) relating to anti-money laundering or counter-terrorism;
s) use the Services to violate the privacy of others or to “stalk” or otherwise harass another;
t) infringe the rights of FORSEEE, including any intellectual property rights and any passing off of the same thereof;
u) use the Services to collect or store personal data about other Users in connection with the prohibited conduct and activities set forth above; and/or
You understand that all Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such Content originated. This means that you, and not FORSEEE, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available through the Site. You understand that by using the Site, you may be exposed to Content that you may consider to be offensive, indecent or objectionable. To the maximum extent permitted by applicable law, under no circumstances will FORSEEE be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of, or reliance on, any Content posted, emailed, transmitted or otherwise made available on the Site.
You acknowledge that FORSEEE and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, delete, remove or move any Content, including without limitation any Content or information posted by you, that is available on the Site. Without limiting the foregoing, FORSEEE and its designees shall have the right to remove any Content
(i) that violates these Terms of Service;
(ii) if we receive a complaint from another User;
(iii) if we receive a notice of intellectual property infringement or other legal instruction for removal; or
(iv) if such Content is otherwise objectionable.
We may also block delivery of a communication (including, without limitation, status updates, postings, messages and/or chats) to or from the Services as part of our effort to protect the Services or our Users, or otherwise enforce the provisions of these Terms and Conditions. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including, without limitation, any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you have not and, to the maximum extent permitted by applicable law, may not rely on any Content created by FORSEEE or submitted to FORSEEE, including, without limitation, information in FORSEEE Forums and in all other parts of the Site.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
Our Service may contain links to third-party web sites or services that are not owned or controlled by FORSEEE.
FORSEEE has no responsibility and no control over the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that FORSEEE shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 (change this) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
